近年来欧盟市场上关于跨境电商渠道入境产品的质量安全通报呈上升趋势,相较于传统贸易,其商品的来源追溯和责任追究成了市场监管部门的难点,欧盟意图通过该项新法规来确保欧盟各国政府监管机构可对所有产品进行监督和问责。
根据新法规要求,欧盟对经济运营者有资质、责任和义务等诸多要求,如果产品出现重大安全问题,欧盟的经济运营者也需要承担相应的法律责任。
为帮助输欧企业更好地理解新法规要求,以免新法规实施后,面临产品被扣留或退运的风险,现在就来解答一下大家比较关心的几个问题:
▎什么是经济运营者?
经济运营者(Economic Operator)是用于描述参与产品供应链的所有商业实体(从个人到跨国公司)的广义术语。
可以是制造商、进口商、分销商或授权代表,每个实体都对其提供的产品负有特定责任。
当产品投放欧盟市场时,从事这项工作的经济运营者对产品的安全性和符合性承担最终责任。
由于市场监管是参照技术文件和产品进行的,因此欧盟境内必须有一个经济运营者持有该文件,以便在必要时将其提供给管理部门。
 
此外,在发现产品不安全、需要采取召回等措施时,相关经济运营者也要负责此类事项。
 
举个例子,在中国与欧盟的跨境贸易中,制造商和经销商在中国,而消费者和检查产品安全的欧盟市场监管机构在欧盟,基于客观原因,欧盟监管部门只能对欧盟境内企业行使权力,如果从中国出口到欧盟的产品出了问题,欧盟监管部门很难与中国制造商直接取得联系。

▎经济运营者必须在欧盟实际存在吗?

▎经济运营者如何授权,要承担什么样的责任义务?
欧盟的经济运营者可以是向欧盟消费者销售产品的传统进口商,也可以是海外仓。
在这种情况下,欧盟的消费者从网站上购买产品,卖家通过海外仓将产品发送给欧盟消费者,而不通过传统进口商,中国制造商也可以委托位于欧盟的“授权代表”代其行事。
欧盟对授权代表规定了严格的要求和义务。
首先,制造商必须通过双方签署的书面授权书对其代表进行授权,如果欧盟当局与授权代表联系,授权书必须允许他代表制造商发言。
要注意的是,只有制造商才能向授权代表签发此类授权书,经销商不能进行授权,欧盟的法规还要求欧盟成员国制定不履行相关法律义务的处罚条例,所以一旦出问题,授权代表需要承担法律后果。

经济运营者的4项任务: 
第一,经济运营者必须核实已经起草了符合性声明和技术文件,而且必须保存符合性声明至少10年。
第二,这10年期间,如果欧盟市场监管机构要求,经济运营者必须在10天内将这些信息提供给相关机构。
第三,如果经济运营者确信产品不安全,必须主动联系市场监管机构。
第四,经济运营者必须与市场监管机构合作或自行采取行动,下架不安全的产品或者降低市场上不安全产品引起的风险。
▎新法规实施后,如果在欧盟没有经济运营者作为代表,能否在欧盟销售产品?
这不符合新法规的要求。
在欧盟你不能直接同个人消费者打交道,除非在欧盟有人对你销售的产品负责,欧盟关于经济运营者的法规意在填补跨境贸易的漏洞,并为所有希望与欧盟消费者做生意的企业创造一个公平竞争的环境,如果想从欧盟市场中分一杯羹,所有企业都必须遵守相同的规则,即欧盟从7月16日生效的新规则。
▎如何标示欧盟代表(经济运营者)的联系方式?如何与CE标志旁的制造商信息进行区分?
欧盟代表的联系方式应标示在产品、产品包装、包裹或随附文件上。

In recent years, the quality and safety notification of cross-border e-commerce channel entry products in the EU market is on the rise. Compared with the traditional trade, the traceability and accountability of their products have become the difficulties for the market regulatory authorities. The EU intends to ensure that the EU government regulatory agencies can supervise and accountability all products through the new law.
According to the requirements of the new regulations, the European Union has many requirements on the qualification, responsibility and obligation of economic operators. If there are major safety problems in products, the economic operators of the European Union also need to bear the corresponding legal responsibility.

▎ what is an economic operator?
Economic operator is a broad term used to describe all business entities (from individuals to multinational corporations) participating in the product supply chain.
It can be a manufacturer, importer, distributor or authorized representative, and each entity has a specific responsibility for the products it provides.
When the products are put on the EU market, the economic operators who are engaged in this work bear the ultimate responsibility for the safety and compliance of the products.
Since market regulation is carried out with reference to technical documents and products, there must be an economic operator in the EU who holds the documents in order to provide them to the management department when necessary.
In addition, when it is found that the product is unsafe and needs to be recalled, the relevant economic operators should also be responsible for such matters.
For example, in the cross-border trade between China and the EU, manufacturers and distributors are in China, while consumers and EU market regulators, which check product safety, are in the EU. For objective reasons, EU regulators can only exercise power over enterprises within the EU. If there is a problem with products exported from China to the EU, It is difficult for EU regulators to get in touch with Chinese manufacturers directly.
Therefore, the new regulation requires that from July 16, 2021, in order to sell products in the EU market, there must be an economic operator in the EU, so that the EU authorities can contact consumers.
▎ do economic operators have to exist in the EU?
The current EU regulations generally define the EU economic operators as manufacturers, importers or distributors and other business organizations.
After the implementation of the new regulation, enterprises outside the EU must have an economic operator who actually exists in the EU. The economic operator must have an office in the EU Member States, not only a contact mailbox, but also an ordinary citizen. The economic operator must be a legal person, that is, an enterprise. The new regulation lists the product categories that need economic operators in the annex, In short, these requirements basically cover all common consumer goods, and are mandatory for all products requiring CE certification, such as toys and electronic products.
▎ how to authorize economic operators, and what responsibilities and obligations should they undertake?
The economic operators of the EU can be traditional importers of products to EU consumers or overseas warehouses.
In this case, the EU consumers buy products from the website, and the sellers send the products to the EU consumers through the overseas warehouse instead of the traditional importers. The Chinese manufacturers can also entrust the "authorized representative" in the EU to act on their behalf.
EU has set strict requirements and obligations for authorized representatives.
First, the manufacturer must authorize its representative by a written power of attorney signed by both parties. If the EU authorities contact the authorized representative, the power of attorney must allow him to speak on behalf of the manufacturer.
It should be noted that only the manufacturer can issue such a power of attorney to the authorized representative, and the distributor can not authorize. EU regulations also require EU Member States to formulate punishment regulations for non-compliance with relevant legal obligations. Therefore, in case of problems, the authorized representative needs to bear the legal consequences.
The economic operator is an entity that can be investigated for legal and economic responsibilities by the EU authorities. When problems are found, someone in the entity must be contacted at the first time and be present in person. If the product is considered unsafe or does not fully meet the requirements of regulatory standards, he must bear the consequences for all injuries and losses.
Four tasks of economic operators:
First, economic operators must verify that compliance statements and technical documents have been drafted and that compliance statements must be kept for at least 10 years.
Second, during this 10-year period, if required by EU market regulators, economic operators must provide such information to relevant institutions within 10 days.
Third, if economic operators are convinced that their products are unsafe, they must take the initiative to contact market regulators.
Fourth, economic operators must cooperate with market regulators or take actions on their own to remove unsafe products or reduce the risks caused by unsafe products on the market.
▎ after the implementation of the new regulations, if there is no economic operator as a representative in the EU, can products be sold in the EU?
This does not meet the requirements of the new regulations.
In the EU, you can't deal directly with individual consumers unless someone in the EU is responsible for the products you sell. The EU regulations on economic operators are intended to fill the loopholes in cross-border trade and create a level playing field for all enterprises that want to do business with EU consumers.
