1暂时进出境货物是什么?

答:暂时进出境货物是指因特定目的暂时进出我国关境,在海关规定的期限内,除因正常使用而产生的折旧或损耗外,应该原状复运出进境的货物。
2暂时进出境货物包括哪些?

答:根据《中华人民共和国海关暂时进出境货物管理办法》(海关总署令第233号)规定,暂时进出境货物包括:

1在展览会、交易会、会议以及类似活动中展示或者使用的货物。

文化、体育交流活动中使用的表演、比赛用品。

2进行新闻报道或者摄制电影、电视节目使用的仪器、设备以及用品。

开展科研、教学、医疗活动使用的仪器、设备和用品。

4在本款第(一)项至第(四)项所列活动中使用的交通工具以及特种车辆。

货样。

7慈善活动使用的仪器、设备以及用品。

供安装、调试、检测、修理设备时使用的仪器以及工具。

8盛装货物的包装材料。

注:使用货物暂准进口单证册(以下简称“ATA单证册”)暂时进境的货物限于我国加入的有关货物暂准进口的国际公约中规定的货物,ATA单证册的有效期为一年,当事人可以在有效期内重复使用。根据《关于暂时进出境货物监管有关事宜的公告》(海关总署公告2019年第13号)规定,海关签注ATA单证册项下暂时进出境货物的进出境期限与单证册有效期一致。

3暂时进出境货物应向哪个海关申报?

答:根据《中华人民共和国海关暂时进出境货物管理办法》(海关总署令第233号)规定,ATA单证册持证人、非ATA单证册项下暂时进出境货物收发货人(以下简称“持证人、收发货人”)可以在申报前主管地海关提交《暂时进出境货物确认申请书》,申请对有关货物是否属于暂时进出境货物进行审核确认,并且办理相关手续,也可以在申报环节直接向主管地海关办理暂时进出境货物的有关手续。

注意:主管地海关,是指暂时进出境货物进出境地海关。境内展览会、交易会、会议以及类似活动的主管地海关为其活动所在地海关。

4暂时进出境货物如何申报?

答:企业可通过中国国际贸易“单一窗口”→货物申报→进/出口整合申报模块进入系统提交申报资料,如主管地海关需验核或补充信息,需提交纸本资料。具体情况以主管地海关审核情况为准。

5暂时进出境货物期限有哪些要求?

答:根据《中华人民共和国海关暂时进出境货物管理办法》(海关总署令第233号)规定,暂时进出境货物应当在进出境之日起6个月内复运出境或者复运进境。

因特殊情况需要延长期限的,持证人、收发货人应当向主管地海关办理延期手续,延期最多不超过3次,每次延长期限不超过6个月。延长期届满应当复运出境、复运进境或者办理进出口手续。

国家重点工程、国家科研项目使用的暂时进出境货物以及参加展期在24个月以上展览会的展览品,在前款所规定的延长期届满后仍需要延期的,由主管地直属海关批准。

注意:申请延期应当在规定期限届满前向主管地海关办理延期手续。主管地海关是指暂时进出境货物进出境地海关,境内展览会、交易会、会议以及类似活动的主管地海关为其活动所在地海关。

6暂时进出境货物结案手续如何办理?

答:暂时进出境货物收发货人在货物复运出境、复运进境后,应当向主管地海关办理结案手续。

暂时进出境货物因不可抗力的原因受损,无法原状复运出境、复运进境的,持证人、收发货人应当及时向主管地海关报告,可以凭有关部门出具的证明材料办理复运出境、复运进境手续;因不可抗力的原因灭失的,经主管地海关核实后可以视为该货物已经复运出境、复运进境

暂时进出境货物因不可抗力以外其他原因受损或者灭失的,持证人、收发货人应当按照货物进出口的有关规定办理海关手续。

1What are temporary inbound and outbound goods?

Answer: Temporary inbound and outbound goods refer to goods that temporarily enter and leave my country's customs territory for a specific purpose. Within the time limit specified by the customs, except for the depreciation or wear and tear caused by normal use, they should be re-transported into and out of the country as they are.

2What are the temporary inbound and outbound goods?

Answer: According to the "Administrative Measures of the Customs of the People's Republic of China on Temporary Inbound and Outbound Goods" (Order No. 233 of the General Administration of Customs), temporary inbound and outbound goods include:

1 Goods displayed or used at exhibitions, trade fairs, conferences and similar events.

Performance and competition supplies used in cultural and sports exchange activities.

2. Instruments, equipment and supplies used for news reporting or filming of movies and TV programs.

Instruments, equipment and supplies used in scientific research, teaching and medical activities.

4. The means of transport and special vehicles used in the activities listed in items (1) to (4) of this paragraph.

Note: The goods temporarily imported using the Temporary Import Carnet of Goods (hereinafter referred to as "ATA Carnet") are limited to the goods stipulated in the international conventions concerning the temporary import of goods to which my country has joined. The validity period of the ATA Carnet is one month. years, and the parties can use it repeatedly within the validity period. According to the "Announcement on Matters Concerning the Supervision of Temporarily Inbound and Outbound Goods" (Announcement No. 13 of 2019 of the General Administration of Customs), the entry and exit period for temporary inbound and outbound goods under the ATA carnet endorsed by the customs is the same as the validity period of the carnet.

3Which customs should the temporary inbound and outbound goods be declared to?

Answer: According to the "Administrative Measures of the Customs of the People's Republic of China for Temporary Inbound and Outbound Goods" (Order No. 233 of the General Administration of Customs), the holder of the ATA carnet, the consignee and consignor of the temporary inbound and outbound goods under the non-ATA carnet ( hereinafter referred to as "certificate holder, consignee and consignor") can submit the "Application for Confirmation of Temporary Inbound and Outbound Goods" to the competent local customs before the declaration, to apply for verification and confirmation of whether the relevant goods are temporary inbound and outbound goods, and go through relevant procedures , or go through the relevant procedures for temporary inbound and outbound goods directly to the competent local customs during the declaration process.

Note: The competent customs refers to the customs of the temporary entry and exit goods. The competent customs office for domestic exhibitions, trade fairs, conferences and similar activities is the customs office where the activities are located.

4How to declare temporary inbound and outbound goods?

Answer: Enterprises can enter the system through the China International Trade "Single Window" → Cargo Declaration → Import/Export Integrated Declaration Module to enter the system to submit declaration materials. If the competent customs needs to verify or supplement information, they need to submit paper materials. The specific situation is subject to the review by the competent local customs.

5What are the requirements for the period of temporary inbound and outbound goods?

Answer: According to the "Administrative Measures of the Customs of the People's Republic of China on Temporary Inbound and Outbound Goods" (Order No. 233 of the General Administration of Customs), temporary inbound and outbound goods should be re-exported or re-imported within 6 months from the date of entry and exit.

If the time limit needs to be extended due to special circumstances, the holder, the consignee and the consignor shall go through the extension procedures with the competent local customs. When the extension period expires, the goods shall be re-exported, re-exported or imported or exported.

Temporary inbound and outbound goods used in national key projects, national scientific research projects, and exhibits participating in exhibitions with a duration of more than 24 months, if the extension period specified in the preceding paragraph still needs to be extended, it shall be approved by the customs directly under the competent jurisdiction.

6How to handle the settlement procedures for temporary inbound and outbound goods?

Answer: The consignee and consignor of temporarily inbound and outbound goods shall go through the settlement procedures with the competent customs after the goods are re-exported out of the country and re-inbound.

If the temporarily inbound and outbound goods are damaged due to force majeure and cannot be re-exported or re-transported into the country in their original state, the certificate holder, consignee and consignee shall report to the competent customs in a timely manner, and the re-shipment can be handled with the certification materials issued by the relevant departments. Exit and re-entry procedures; if it is lost due to force majeure, it can be deemed that the goods have been re-exported or re-entered after verification by the competent customs.

If the goods temporarily entering or leaving the country are damaged or lost due to reasons other than force majeure, the certificate holder, consignee and consignor shall go through customs formalities in accordance with the relevant regulations on import and export of goods.
